These Terms of Service (“Terms”) govern access to cozybead.com and related online services. Product purchases are also governed by our Terms of Sale, Shipping Policy, Refund Policy and Privacy Policy. By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. About us

2. Eligibility and accounts

You must be legally capable of entering into these Terms or use the Services with the involvement of a parent or legal guardian. You are responsible for accurate account information, protecting credentials and activity under your account. Tell us promptly if you suspect unauthorized access.

3. Acceptable use

You may not:

use the Services for unlawful, fraudulent or abusive activity;
interfere with security, availability or normal operation;
introduce malware, scrape at a rate that burdens the Services, bypass access controls or attempt unauthorized access;
misrepresent identity, payment authority or affiliation;
copy, modify or exploit site content except as allowed by law or written permission; or
use the Services to infringe intellectual-property, privacy or other rights.

4. Product information and color display

We aim to describe products accurately. Screen settings, lighting and photography can affect color appearance, so on-screen color is a reference rather than a guarantee of exact visual matching. Dimensions, capacity and compatibility may have reasonable manufacturing tolerances. Confirm critical requirements before purchase.

5. Intellectual property

The Services and their original text, graphics, interface, branding, photographs, product designs and software are owned by or licensed to CozyBead and protected by applicable laws. CozyBead grants you a limited, revocable, non-transferable right to use the Services for personal shopping and lawful business with us.

Third-party names and marks belong to their respective owners. Reference to a bead size, color system or compatible craft method does not imply sponsorship or affiliation unless expressly stated.

6. User content and feedback

If you submit a review, project image, suggestion or other content, you confirm you have the rights needed to do so and that the content is lawful. You grant CozyBead a non-exclusive, worldwide, royalty-free license to host, reproduce and display the content for operating, promoting and improving the Services, subject to applicable privacy law. We may remove content that violates these Terms. You retain ownership of your content.

7. Third-party services

Shopify, payment providers, carriers and other third parties support the Services. Their own terms may apply to features they provide. We are not responsible for third-party sites reached through external links, but this does not limit responsibility that cannot lawfully be excluded.

8. Availability and changes

We may maintain, update or change the Services and may suspend access to protect security, comply with law or address technical issues. We do not promise uninterrupted availability. Changes do not affect rights already acquired under an accepted order.

9. Disclaimers

To the maximum extent permitted by law, the Services are provided on an “as available” basis. We disclaim implied promises relating solely to use of the website where they may lawfully be disclaimed. We do not exclude guarantees, warranties or remedies that consumer law makes mandatory.

10. Limitation of liability

Nothing in these Terms excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, willful misconduct, or any liability that law does not allow us to exclude. Subject to that, we are not liable for indirect or consequential loss that was not reasonably foreseeable when you used the Services. For non-consumer use, our aggregate liability arising solely from website use is limited to the greater of USD 100 or the amount you paid us in the previous 12 months, to the extent permitted by law.

11. Indemnity for business misuse

If you use the Services on behalf of a business, you agree to indemnify CozyBead against third-party claims caused by your unlawful use or material breach of these Terms, except to the extent the claim results from our own breach or negligence. This clause does not apply to consumers acting for personal purposes.

12. Governing law and disputes

These Terms are governed by the laws of Hong Kong, without depriving consumers of mandatory protections or forum rights under the law of their habitual residence. We encourage you to contact us first so we can try to resolve a concern. Courts with jurisdiction under applicable law may hear unresolved disputes.

13. General

If any provision is unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a business reorganization or sale, provided your rights are not reduced. These Terms and referenced policies are the agreement about use of the Services.
